These Terms of Service ("Terms") govern your use of Smart Pager, an after-hours messaging service operated by Sudanim Pty Ltd ("we", "us", "our"). By using Smart Pager, you agree to these Terms.
Smart Pager provides an after-hours paging and messaging service. We provide you with a dedicated phone number that receives calls, records messages, transcribes them, and delivers notifications to your devices. You can also request photos from your clients through a secure, token-based link sent via SMS.
To use Smart Pager, you must create an account and provide accurate information. You are responsible for maintaining the security of your account and for all activities that occur under your account.
By subscribing to Smart Pager and providing your mobile phone number, you expressly consent to receive SMS text messages from us at that number. These messages include:
Message frequency varies based on incoming calls to your Smart Pager number. Message and data rates may apply. You may disable SMS notifications at any time through your notification settings, but doing so means you will rely solely on push notifications for message alerts.
By enabling push notifications in the Smart Pager application, you consent to receiving push notifications on your registered devices for new messages, reminders, and service alerts. You can disable push notifications at any time through your device settings or the Smart Pager notification settings page. Push notifications are the primary method of delivery and are recommended for reliable message receipt.
Smart Pager is a paid subscription service. By subscribing, you agree to pay the monthly fee of $60 + GST ($66 total) charged to your payment method on a recurring basis. You may cancel your subscription at any time.
If payment fails, we may suspend your service until payment is received. We reserve the right to change our pricing with 30 days' notice.
You agree not to use Smart Pager to:
Smart Pager is a messaging service, not an emergency service. We do not provide clinical advice, triage, or decision support. All messages are delivered equally regardless of content. You are solely responsible for determining the appropriate response to any message.
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur.
Your use of Smart Pager is also governed by our Privacy Policy. We store call recordings and transcriptions securely in Australia and retain them for 7 years for compliance purposes.
Smart Pager and its associated trademarks, logos, and content are owned by Sudanim Pty Ltd. You may not copy, modify, or distribute our intellectual property without permission.
To the maximum extent permitted by law, Sudanim Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Smart Pager.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the service in the 12 months preceding the claim.
You agree to indemnify and hold harmless Sudanim Pty Ltd from any claims, damages, or expenses arising from your use of Smart Pager or violation of these Terms.
We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your access to the service will end and your data will be handled in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify you of significant changes by email. Continued use of the service after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
Smart Pager is priced to reflect typical after-hours professional usage. We want the service to work reliably for everyone, so we ask that accounts are used in line with reasonable on-call workloads.
If an account's usage of calls, messages, or photo requests significantly exceeds what would be expected for a professional on-call service, we reserve the right to get in touch to discuss your needs and, if appropriate, arrange pricing or terms that better fit your usage.
We will always contact you first. Our goal is to find a solution that works for both of us, not to penalise normal use.
